End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and Requisite Technologies, Inc. ("Commit 250", "we", "us", or "our"), a corporation based in Nebraska, governing your use of the Commit 250 mobile application (the "App") and any related services, including those accessed via our website at https://commit250.com. By downloading, installing, accessing, or using the App, you agree to be bound by this EULA. If you do not agree to these terms, do not use the App.

This EULA is based on standard platform licensing agreements, such as Apple’s Standard EULA (available at https://www.apple.com/legal/internet-services/itunes/us/terms.html) for iOS users, and incorporates additional provisions to address specific features of the Commit 250 App, including online signup, auto-renewable subscriptions, fitness program disclaimers, content usage, and privacy practices as outlined in our Privacy Policy (available at https://commit250.com/your-data).

1. Scope of License

The App is licensed, not sold, to you for use only under the terms of this EULA. Commit 250 grants you a non-transferable, non-exclusive license to use the App on devices that you own or control, as permitted by the usage rules of the applicable platform (e.g., Apple Media Services Terms and Conditions for iOS or Google Play Terms of Service for Android). The App may be accessed by other accounts associated with you via platform-specific features, such as Family Sharing on iOS or equivalent mechanisms on Android, where applicable.

This license does not allow you to:

  • Use the App on any device you do not own or control.
  • Distribute, sell, lease, rent, lend, sublicense, or otherwise transfer the App.
  • Copy (except as expressly permitted by this license), decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App, any updates, or any part thereof (except as permitted by applicable law).

2. Online Signup and Auto-Renewable Subscriptions

The App and related services may be accessed through online signup at https://commit250.com. By signing up through the website or the App, you agree that the same terms, including this EULA and our Privacy Policy (https://commit250.com/your-data), apply to all services, including account creation, usage, and auto-renewable subscriptions or in-app purchases.

Auto-Renewable Subscriptions

  • The App offers auto-renewable subscriptions for premium or exclusive content, processed through the respective platform’s payment system (e.g., Apple’s In-App Purchase for iOS or Google Play Billing for Android).
  • Subscription terms, including pricing, billing frequency, and cancellation procedures, are presented at the time of purchase via the platform’s payment dialogs and within the App’s user interface.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions through your platform account (e.g., Apple ID in the Settings app for iOS or Google Play account for Android) or via the App’s subscription management link.
  • By subscribing, you agree to the applicable platform’s payment terms (e.g., Apple’s Standard EULA at https://www.apple.com/legal/internet-services/itunes/us/terms.html for iOS users or Google Play Terms of Service at https://play.google.com/intl/en_us/about/play-terms.html for Android users) and this EULA, which govern the use of premium or exclusive content accessed through subscriptions.

3. Fitness Program Disclaimer

The Commit 250 App provides a fitness program designed to help you track and achieve your fitness goals. As with any exercise or diet program, you should consult your healthcare professional before beginning or modifying your fitness routine. By using the App, you acknowledge and agree that:

  • You are responsible for assessing your physical condition and suitability for the fitness program.
  • Commit 250 and Requisite Technologies, Inc. are not liable for any injuries, health issues, or damages resulting from your participation in the fitness program.
  • You assume all risks associated with the use of the App’s fitness content, including but not limited to exercise recommendations, dietary suggestions, or tracking features.

4. Content Usage and Sharing

The App contains both free and premium/exclusive content, as described below:

Free Content

  • All content in the App that is not marked as "premium" or "exclusive" is considered free for reuse or sharing, provided the intent of sharing is not for individual profit or commercial gain.
  • You may share free content (e.g., workout tips, general fitness advice) with others for personal, non-commercial purposes, such as in social media posts, blogs, or community discussions, as long as such sharing complies with this EULA and applicable laws.
  • You may not modify, sell, or use free content for commercial purposes without prior written consent from Commit 250.

Premium or Exclusive Content

  • Content marked as "premium" or "exclusive" within the App or on https://commit250.com (e.g., specialized workout plans, premium videos) is subject to additional licensing restrictions.
  • Premium or exclusive content is accessible only through active subscriptions or in-app purchases and is licensed solely for your personal, non-commercial use.
  • You may not share, reproduce, distribute, or create derivative works from premium or exclusive content without explicit permission from Commit 250.

5. Privacy Policy

Your use of the App is also governed by our Privacy Policy, available at https://commit250.com/your-data. The Privacy Policy outlines how we collect, use, protect, and share your personal data, including:

  • Data Collection: We collect personal data (e.g., name, email, device identifiers) and non-personal data (e.g., usage statistics) to provide and improve the App.

7. Termination

This EULA is effective until terminated by you or Commit 250. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms. Upon termination:

  • You must cease all use of the App and delete all copies from your device.
  • Any subscriptions will continue to renew unless canceled through your platform account, subject to the applicable platform’s payment terms.

Commit 250 may also terminate this EULA or suspend access to the App for reasons including but not limited to violation of this EULA, legal requirements, or protection of our rights, safety, or property.

8. Services and Third-Party Materials

The App may enable access to third-party services and websites (e.g., Apple Sign-In, Google Sign-In, analytics providers). You agree that:

  • Such services are subject to their own terms and privacy policies, which you must review and accept.
  • Commit 250 is not responsible for the content, accuracy, or practices of third-party services.
  • Any third-party content accessed through the App is subject to the licensing terms of the respective provider.

9. Intellectual Property

The App, including all content (except as noted in Section 4), designs, text, graphics, and software, is owned by or licensed to Requisite Technologies, Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks, logos, or other proprietary materials without prior written consent.

10. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Commit 250 does not warrant that:

  • The App will meet your requirements or operate uninterrupted or error-free.
  • Any defects will be corrected.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

11. Limitation of Liability

To the maximum extent permitted by law, Requisite Technologies, Inc., its affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or use, arising out of or in connection with your use of the App, even if advised of the possibility of such damages. In no event shall our total liability exceed the amount you paid for the App or related subscriptions, if any.

12. Compliance with Laws

You agree to use the App in compliance with all applicable laws, including local laws of the country or region in which you reside or use the App. The App is not intended for users under 16, and we do not knowingly collect data from children without parental consent, as stated in our Privacy Policy (https://commit250.com/your-data).

13. Governing Law

This EULA is governed by the laws of the State of Nebraska, USA, without regard to its conflict of law principles, except where prohibited by applicable law (e.g., EU consumer protection laws). Any disputes arising under this EULA shall be resolved in the state or federal courts located in Nebraska.

14. Updates to This EULA

We may update this EULA to reflect changes in our practices or legal requirements. We will notify you of material changes via in-app notifications, email, or by posting the updated EULA at https://commit250.com/terms. Continued use of the App after such changes constitutes your acceptance of the revised EULA.
